Expresiile precum \u201esalariu motivant&#8221; nu vor mai fi permise. Schimbarea va fi aplicat\u0103 \u00een termen de 2 ani pentru a ajusta grila salarial\u0103 \u0219i a se conforma noilor reglement\u0103ri europene.<\/p>\n\n\n\n<p>Potrivit datelor unei mari platforme de recrutare din \u021bar\u0103, peste 40% din anun\u021burile de angajare afi\u0219eaz\u0103 salariul \u00een prezent. Aproape o treime din cele peste 25.000 de oferte disponibile pe aceast\u0103 platform\u0103 asigur\u0103 transparen\u021ba, cu accent pe domenii precum HoReCa, turism sau transporturi. Dar salariile sunt specificate \u0219i \u00een domenii, precum IT, PR sau call-center.<\/p>\n\n\n\n<p>Angajatorii trebuie s\u0103 stabileasc\u0103 criterii clare \u0219i obiective pentru stabilirea salariilor. \u00cens\u0103 Codul Muncii din Rom\u00e2nia \u00eencurajeaz\u0103 confiden\u021bialitatea salariilor, astfel c\u0103 transparen\u021ba devine un element esen\u021bial \u00een atragerea candida\u021bilor potrivi\u021bi \u0219i \u00een asigurarea unei competi\u021bii corecte pe pia\u021ba muncii.<\/p>\n\n\n\n<p>Se a\u0219teapt\u0103 ca num\u0103rul joburilor cu salariul la vedere s\u0103 creasc\u0103 \u00een urm\u0103torii ani, pe m\u0103sur\u0103 ce companiile se adapteaz\u0103 la noile reglement\u0103ri europene. Legisla\u021bia european\u0103 impune \u0219i egalitatea salarial\u0103 \u00eentre sexe, asigur\u00e2nd c\u0103 b\u0103rba\u021bii \u0219i femeile care ocup\u0103 acelea\u0219i pozi\u021bii vor fi pl\u0103ti\u021bi la fel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Directiva UE din mai 2023<\/h2>\n\n\n\n<p>La data de 17 mai 2023, \u00een Jurnalul Oficial al Uniunii Europene a fost publicat\u0103\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/?uri=uriserv%3AOJ.L_.2023.132.01.0021.01.RON&amp;toc=OJ%3AL%3A2023%3A132%3ATOC\">Directiva (UE) 2023\/970<\/a> a Parlamentului European \u0219i a Consiliului din 10 mai 2023\u00a0de \u201econsolidare a aplic\u0103rii principiului egalit\u0103\u021bii de remunerare pentru aceea\u0219i munc\u0103 sau pentru o munc\u0103 de aceea\u0219i valoare \u00eentre b\u0103rba\u021bi \u0219i femei, prin transparen\u021b\u0103 salarial\u0103 \u0219i mecanisme de asigurare a respect\u0103rii legii\u201d.<\/p>\n\n\n\n<p>Directiva urm\u0103re\u0219te stabilirea unor standarde de transparen\u021b\u0103 salarial\u0103, prin:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>introducerea unor obliga\u021bii de raportare pentru marii angajatori cu privire la egalitatea de remunerare;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>reglementarea dreptului angaja\u021bilor la informa\u021bii din partea angajatorului cu privire la nivelul lor salarial \u0219i la nivelurile salariale medii;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>crearea unor mecanisme care \u00eembun\u0103t\u0103\u021besc aplicarea principiului egalit\u0103\u021bii de remunerare.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Transpunerea propriu-zis\u0103 a Directivei se va \u00eemplini la data de&nbsp;7 iunie 2026.<\/h2>\n\n\n\n<p>Platforma <a href=\"https:\/\/www.startupcafe.ro\/taxe\/transparenta-salarii-obligatii-firme-angajatori-adoptare-directiva.htm\">Start Up Caf\u00e9<\/a> a prezentat o analiz\u0103 realizat\u0103 de Anca Atanasiu, avocat \u0219i Senior Managing Associate la B\u0103ncil\u0103, Diaconu \u015fi Asocia\u0163ii. Aceste informa\u021bii vor fi comunicate \u00eentr-un moment oportun, de exemplu, prin anun\u021bul de angajare sau \u00eenaintea interviului, pentru a facilita procesul de negociere a salariului;<\/p>\n\n\n\n<p>Noua reglementare&nbsp;nu&nbsp;permite angajatorilor&nbsp;s\u0103 solicite informa\u021bii despre salariul actual sau istoricul salarial al candida\u021bilor;<\/p>\n\n\n\n<p>Anun\u021burile de posturi vacante \u0219i denumirile locurilor de munc\u0103 vor trebui s\u0103 fie\u00a0neutre din punct de vedere al genului,<\/p>\n\n\n\n<p>Angajatorii vor fi obliga\u021bi s\u0103 pun\u0103 la dispozi\u021bia salaria\u021bilor, \u00eentr-un mod accesibil, criteriile obiective, neutre din punctul de vedere al genului&nbsp;care sunt utilizate pentru a determina salariul, evolu\u021bia acestuia \u0219i nivelurile salariale;<\/p>\n\n\n\n<p>Angaja\u021bii sau partenerii sociali ai acestora&nbsp;vor putea solicita informa\u021bii cu privire la propriul nivel salarial \u0219i la nivelurile salariale medii pentru categoriile de salaria\u021bi care presteaz\u0103 aceea\u0219i munc\u0103&nbsp;sau o munc\u0103 de aceea\u0219i valoare ca a lor, precum \u0219i clarific\u0103ri \u0219i informa\u021bii suplimentare \u00een leg\u0103tur\u0103 cu datele furnizate. Angajatorii vor trebui s\u0103 se asigure c\u0103 procedura de urmat pentru exercitarea acestui drept este adus\u0103 la cuno\u0219tin\u021ba salaria\u021bilor \u00een fiecare an. Criteriile pot include, de exemplu, competen\u021bele, efortul, responsabilitatea, condi\u021biile de munc\u0103 \u0219i, dac\u0103 este cazul, orice al\u021bi factori care sunt relevan\u021bi pentru postul sau locul de munc\u0103 specific.<\/p>\n\n\n\n<p>O alt\u0103 m\u0103sur\u0103 de impact pentru angajatori va fi\u00a0eliminarea clauzelor de confiden\u021bialitate a salariului.<\/p>\n\n\n\n<p>Salaria\u021bii nu vor mai putea fi \u00eempiedica\u021bi s\u0103 divulge informa\u021bii despre remunera\u021bia lor \u00een scopul asigur\u0103rii aplic\u0103rii principiului egalit\u0103\u021bii de remunerare. \u00cen ceea ce prive\u0219te informa\u021biile ob\u021binute \u00een virtutea dreptului la informare, altele dec\u00e2t cele referitoare la propriul salariu sau propriul nivel salarial, angajatorii vor putea solicita salaria\u021bilor s\u0103 le utilizeze numai \u00een scopul de a-\u0219i exercita dreptul la egalitatea de remunerare.<\/p>\n\n\n\n<p>Angajatorii vor fi obliga\u021bi s\u0103 raporteze organismului de monitorizare competent\u00a0o serie de date referitoare la discrepan\u021bele salariale dintre femei \u0219i b\u0103rba\u021bi.\u00a0Aceast\u0103 obliga\u021bie se va aplica pentru companiile cu cel pu\u021bin 100 de angaja\u021bi.<\/p>\n\n\n\n<p>Informa\u021biile raportate vor fi comunicate \u0219i salaria\u021bilor \u0219i partenerilor sociali ai acestora, precum \u0219i inspectoratului de munc\u0103 \u0219i organismul de promovare a egalit\u0103\u021bii competent, la cererea acestora din urm\u0103.<\/p>\n\n\n\n<p>Identificarea unei&nbsp;diferen\u021be \u00een ceea ce prive\u0219te nivelul salarial mediu \u00eentre angaja\u021bii de gen feminin \u0219i masculin de cel pu\u021bin 5%&nbsp;\u00een cazul oric\u0103rei categorii de salaria\u021bi, nejustificat\u0103 obiectiv \u0219i neremediat\u0103 \u00een termen de 6 luni de la data transmiterii raport\u0103rii va atrage necesitatea demar\u0103rii unei evalu\u0103ri comune, prin cooperarea angajatorului cu partenerii sociali.<\/p>\n\n\n\n<p>Salaria\u021bii care se consider\u0103 nedrept\u0103\u021bi\u021bi ca urmare a nerespect\u0103rii principiului egalit\u0103\u021bii de remunerare \u00een ceea ce \u00eei prive\u0219te se vor putea adresa instan\u021bei de judecat\u0103, prezent\u00e2nd fapte ce permit s\u0103 se presupun\u0103 existen\u021ba discrimin\u0103rii directe sau indirecte. \u00cen aceste situa\u021bii, Directiva transfer\u0103 sarcina probei c\u0103tre angajator.<\/p>\n\n\n\n<p>\u00cen ceea ce prive\u0219te desp\u0103gubirile, acestea vor trebui s\u0103 includ\u0103 recuperarea integral\u0103 a pl\u0103\u021bilor restante \u0219i a primelor sau a pl\u0103\u021bilor \u00een natur\u0103 aferente, desp\u0103gubiri pentru oportunit\u0103\u021bile pierdute, prejudicii morale, orice prejudiciu cauzat de al\u021bi factori relevan\u021bi, precum \u0219i dob\u00e2nzi de \u00eent\u00e2rziere.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Companiile de pe pia\u021ba rom\u00e2neasc\u0103 vor trebui s\u0103 specifice salariile \u00een anun\u021burile de angajare, potrivit unei directive UE.
